Terms of Service
Please read these Terms of Service carefully before using the AutoCare platform. By accessing or using AutoCare, you agree to be bound by these terms.
1. Service Description
AutoCare provides an AI-powered customer support automation platform for D2C (direct-to-consumer) ecommerce brands. The platform enables brands to automate customer conversations across channels including WhatsApp, Instagram, and email using artificial intelligence.
2. Eligibility
- You must represent a registered business entity in India to use AutoCare.
- You must have the legal authority to enter into these Terms on behalf of your business.
- AutoCare is not available for personal/consumer use.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials and API tokens.
- You must provide accurate and current business information during registration and keep it updated.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@autocare.in if you suspect unauthorised access to your account.
4. Payment Terms
- AutoCare is offered on a credit-based subscription model. Plans are billed at the time of purchase.
- All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
- Credits purchased as part of a plan are non-refundable once used to process conversations or API calls.
- We reserve the right to change pricing with 30 days notice. Existing subscriptions will not be affected within the current billing cycle.
- Failed or disputed payments may result in temporary suspension of service.
5. Acceptable Use
You agree not to use AutoCare to:
- Violate any applicable laws or regulations.
- Send spam, unsolicited messages, or bulk marketing without recipient consent.
- Impersonate any person, business, or entity.
- Transmit malicious code or interfere with the platform's operation.
- Violate Meta's WhatsApp Business Policy or Instagram Platform Terms.
- Process sensitive personal data (such as financial credentials of end-customers) through the AI conversation pipeline.
6. Service Availability
We target 99% monthly uptime for the AutoCare platform. However, we do not provide a guaranteed uptime SLA unless explicitly agreed in a separate written agreement. Planned maintenance will be communicated in advance where possible.
AutoCare is not responsible for downtime caused by third-party services (WhatsApp, Shopify, OpenAI, etc.).
7. Termination
- You may cancel your subscription at any time from your account settings.
- We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice depending on severity.
- Upon termination, your access to the platform and data will be disabled. Data will be deleted within 30 days per our Privacy Policy.
8. Limitation of Liability
AutoCare provides AI-generated responses as a tool to assist brands in customer communication. We are not responsible for:
- Errors, inaccuracies, or omissions in AI-generated responses.
- Business losses, customer disputes, or reputational harm arising from AI responses.
- Data loss due to third-party service failures.
To the maximum extent permitted by law, AutoCare's total liability in connection with these Terms shall not exceed the amount you paid for the platform in the 3 months preceding the claim.
9. Intellectual Property
AutoCare and its underlying technology remain the exclusive property of AutoCare. You retain ownership of your business data and conversation history.
10. Governing Law
These Terms are governed by the laws of India. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Haryana, India.
